Condition 7 Requirements

7. As a voluntary condition of approval, the Property Owner agrees to enter into a Declaration of Restrictions and Covenants (“Covenant”), as hereinafter stated in this condition, acceptable to the Village Attorney, whereby no residential and non-residential building permits for vertical construction for new development within Equestrian Village and no residential building permits for vertical construction for White Birch Farms (Equestrian Village and White Birch Farms shall hereinafter be collectively referred to as “Subject Property”) until such time as: (1) the Covenant has been recorded in the Public Records of Palm Beach County, Florida; (2) the new equestrian facilities, intended for use by dressage, hunter jumper, and other appropriate equestrian events and as set forth below in items a through g (“New Showground Facility”), are constructed in accordance with the facilities and specifications referenced below; (3) the New Showground Facility is available for use and is in compliance with the applicable United States Equestrian Federation (“USEF”) and Federation Equestre Internationale (“FEI”) facility standards and guidelines, as provided in Exhibit D; and (4) the footing in the arenas of the New Showground Facility is in compliance with then applicable FEI Approved Footing Standard to be tested by objective international performance testing equipment such as an Orono Biomechanical Surface Tester or such other recognized footing testing equipment. The New Showground Facility shall, at a minimum, consist of approximately the following quantities and dimensions:
 

a. Derby field (grass, approximately 159,375 square feet; e.g. 375’ by 425’; 400’ by 400’) and schooling area (approximately 52,500 square feet; e.g. All-Weather Schooling 150’ by 200’ grass Schooling 150’ by 150’; All­ Weather Schooling 300’ by 175’)
 

b. Main arena (defined as arena approximately 87,500 square feet; ; e.g 250’ by 350’; 300’ by 300’) and includes a minimum of 3,000 seats for spectators) and schooling area (approximately 44,000; e.g. 200’ by 220’; 230’ by 195’)
 

c. Four (4) additional arenas each approximately 70,000 square feet (inclusive of schooling areas) e.g 170’ by 420’; 180’ by 400’; e.g competition arena 170’ by 215’, schooling area 170’ by 205’)
 

d. Permanent stabling (minimum 220 stalls, 12’ x 12’ each)
 

e. Lunging area (approximately 42,000 square feet; e.g. 140’ by 300’; 150’ by 280’)
 

f. Fifteen (15) shade structures
 

g. Approximately 70,000 square feet of Arena under cover; (e.g. 170’ by 420’; 200’ by 350’), which may be constructed on an adjacent property.
 

The facilities in items a through g above shall also include the associated elements of vehicle parking, haul-in area, landscaping, stormwater management areas, concession areas, restroom facilities, manure bins, and wash areas. Further, the items a though g may be modified by Village Council as part of the Compatibility Determination application approval for a Commercial Equestrian Arena.
